1. Introduction

Welcome to Prize Whisky. These terms and conditions govern your use of our website and the sale of our products, including participation in our skill-based competitions. By using our website, purchasing our products, or entering our competitions, you agree to these terms and conditions in full. If you do not agree with any part of these terms, you must not use our website or participate in any of our competitions.

These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Age Restrictions

Our products and competitions are only available to individuals aged 18 or over who are residents of the United Kingdom. By purchasing from us or entering a competition, you confirm that you meet these requirements. We reserve the right to request proof of age at any stage, and failure to provide satisfactory evidence may result in order cancellation or disqualification from competitions without refund. Any attempt to circumvent these age restrictions is strictly prohibited.

3. Purchase and Delivery

  • Mystery Pack Allocation: Individual whisky packs are chosen at random from the available pool of different single malt whiskies. If you place an order while logged in, we will try to provide a different whisky each time, although this is not guaranteed. Duplicates may occur if the number of packs ordered exceeds the available pool or if all unique whiskies have already been allocated to you. For orders placed without an account or while not logged in, we will avoid issuing duplicates within the same order unless the order exceeds the number of unique whiskies available.
  • Orders placed before 14:00 (2 pm) on a working day will be dispatched the same day, unless the product is on pre-order or backorder. Orders placed after 14:00, on weekends, or on public holidays will be processed on the next working day. Delivery is generally within 48 hours but is not guaranteed, and delivery times may vary based on external courier conditions.
  • Deliveries are only available within the United Kingdom. We do not deliver to PO boxes or addresses outside of the UK.
  • You are responsible for ensuring that the delivery address provided is correct. We will not be liable for any delays or losses resulting from incorrect or incomplete address details. If a parcel is returned to us due to an incorrect address, you will be responsible for any additional shipping costs.

4. Returns and Refunds

  • We accept returns of unopened packs within 14 days of delivery. The pack must be in its original condition, with no signs of tampering, and the pack code must be unused. Packs that have been tampered with, damaged, or where the pack code has been redeemed are not eligible for return.
  • To initiate a return, please contact us at [email protected] with your order number and details of the item you wish to return. Unless we have made a mistake with your order (e.g., incorrect or defective product), the buyer is responsible for return carriage costs.
  • Returned items must be sent using a trackable shipping method, and you must retain proof of postage until the return is processed. We are not responsible for items lost or damaged in transit during the return process.
  • Refunds will be processed within 14 days of receiving the returned item, provided it meets all return conditions. Original shipping costs are non-refundable unless we have made an error with your order.

5. Competitions

  • To enter our competitions, you must create an account on our website. Your account allows us to securely track your entries and contact you in case you win. Without an account, you will not be able to participate in any of our competitions.
  • Each pack includes a single use unique code that allows the holder to partake in one of our competitions which we promote on our website.
  • Entry to a competition requires entering a valid pack code and answering a series of questions about the undisclosed whisky within the connected pack. Participants receive one prize entry for each correct answer. Each competition will have a different number of questions which will clearly be displayed on the competition page.
  • For subjective questions (e.g., related to taste, aroma, or finish), the correct answer is determined by either the Master Distiller’s official notes or an expert panel. Their decision is final, and no re-entries or refunds will be provided if you disagree with their assessment. No correspondence regarding the outcome of subjective questions will be entered into.
  • Prize Winners will be chosen at random from the pool of correct submissions. The draw will take place within 14 days of the competition closing, and winners will be notified via the contact details in your account. It is your responsibility to ensure that your contact details are up to date. If we are unable to contact a winner within 14 days, we reserve the right to select an alternative winner.
  • Pack codes must be used within six months from the date of purchase. If a code expires, we may, at our sole discretion, reactivate or extend the validity period. However, this is not guaranteed, and we reserve the right to decline any such requests.
  • If for reasons outside of our reasonable control any prize becomes unavailable during the competition, we reserve the right to replace advertised prizes with alternatives of equal or greater value if necessary. Tax-free cash alternatives are available only if explicitly specified on the competition page. Prizes are non-transferable, and no substitutions will be made except at our discretion.
  • Prize delivery is covered throughout the UK, and all efforts will be made to ensure prizes are delivered within 15 days of the winner being announced. We are not liable for any delays caused by circumstances beyond our control.
  • Further Competition specific terms, including but not limited to, the end date, account entry limits, the format of the competition, and the prizes available are specified on each individual competition page.
  • We reserve the right to extend or amend the end date of any competition in the event of unforeseen circumstances beyond our reasonable control, including but not limited to supply chain delays, technical issues, or disruptions affecting fair competition entry. Any changes will be communicated on the relevant competition page.

6. Winner Details, Validation, and Publicity

  • Winners will be contacted via email using the contact details provided at the time of competition entry. It is your responsibility to ensure that your contact information is accurate and up to date. Failure to respond within 14 days of being contacted may result in forfeiture of the prize, and an alternative winner may be selected.
  • We reserve the right to verify the eligibility of all winners, including requiring proof of age, identity, and residency. Winners may be required to send a copy of their passport or other government-issued identification to confirm their identity and age. If the purchase was made by credit card, we may also require proof that the card used was legally theirs or that they had authorisation to use it. Failure to meet these obligations may result in the winner being disqualified, and we reserve the right to choose an alternate winner.
  • All winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by Prize Whisky in connection with the competition and in identifying them as a winner. By entering the competition, you consent to such use without additional compensation.
  • Following receipt and verification of the details requested above, winners will be contacted to make arrangements for delivery of the prize. In the event that the competition did not allow for the pre-selection of a prize, the winner must choose between the selection of prizes available (as detailed in the competition prize information on the website) and notify Prize Whisky of their choice in writing.

7. Intellectual Property

All content on this website, including text, images, products, packaging, and our logo, is protected by copyright and other intellectual property rights owned by Cactus Farm Ltd or our licensors. You may not reproduce, modify, distribute, or otherwise use any of our intellectual property without our prior written consent.

Each mystery whisky is disclosed at the end of the competition process. Please note that any reference to whisky brands is for identification purposes only. The brands involved are not affiliated with this competition and do not endorse Prize Whisky, and all associated intellectual property, including trademarks, names, and logos, remains the property of the respective brand owners.

8. Payment Processing

We use Stripe for secure payment processing. All transactions are encrypted to protect your payment information, and we do not store any payment information on our servers. By making a purchase on our website, you agree to Stripe’s terms and conditions, which can be found on their website. In the event of a payment dispute, we will work with Stripe to resolve the issue in accordance with their procedures.

9. Liability

  • Prize Whisky will not be liable for any indirect, special, or consequential losses, including but not limited to loss of opportunity, winnings, data, or profits.
  • We are not responsible for any technical failures or issues beyond our control that may prevent you from accessing the website, purchasing products, or entering competitions.
  • Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
  • By participating in our competitions, you agree that you are participating at your own risk. We make no representations or warranties regarding the quality, suitability, or fitness for purpose of any prizes offered.

10. Changes to Terms

We may update these terms from time to time to reflect changes in our business operations, legal requirements, or other circumstances. The updated terms will be posted on our website, and the date of the latest revision will be noted. Your continued use of the website or participation in our competitions after any changes constitutes your acceptance of the updated terms. It is your responsibility to review these terms periodically.

11. Severance

If any provision of these terms and conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining terms and conditions and shall not affect the validity and enforceability of the remaining provisions.
